“Why do I need a Fire Risk Assessment”
New fire safety rules affecting all non-domestic premises in England and Wales will come into force in October the Office of the Deputy Prime Minister announced. The Regulatory Reform (Fire Safety) Order, made in June 2005, is the biggest overhaul of fire safety legislation in decades. Originally, it was due to come into force in April but in January the department announced it was deferring to give business and stakeholders more time to prepare. Announcing the new date in a written statement, the ODPM Minister responsible for fire safety Jim Fitzpatrick said:

“The Government’s over-riding aim is to save more people from death and injury by reducing risk and preventing fires.”Over the coming months, we will continue to work with stakeholders to ensure that all those affected by the new rules have the support that they need.”

This legislation requires all employers and building owners to carry out a fire risk assessment. This fire risk assessment must be carried out by a “Competent” person as defined by the order.

“What will happen if I do not carry out a fire risk assessment?”

The regulatory reform (Fire Safety) order states that “Fire and Rescue Authorities will ensure that the duties of the order are met and will have powers to issue enforcement notices to those who do not take their “duties seriously”

Ultimately a breach of legislation could result in the“responsible person”receiving a fine or even a prison sentence.
